TechPoint, Indiana’s technology initiative, awarded the best in technology in Indiana at the 14th Annual TechPoint Mira Awards on Saturday, April 20, 2013. Out of the 14 award categories, Ice Miller LLP clients captured eight awards and received an honorable mention in a ninth category. A total of 20 Ice Miller clietns were nominated.

TechPoint Mira Awards recognize excellence and innovation through the achievement of Indiana’s outstanding technology industry performers and contributors, and focuses attention on the broader issue of the important role technology plays in Indiana’s economy. Ice Miller Pleased to Support TechPoint’s ALHIT Initiative

Ice Miller is a sustaining parter of TechPoint and we are especially pleased to support and play a role in the ALHIT Initiative (Advancing Life Science & Health Care Information Technology).

The mission of ALHIT is to capitalize upon Indiana’s IT leadership and complement statewide life science efforts. This initiative is aimed at creating and growing more information technology companies that will provide innovative solutions for Indiana’s health and life sciences sector. ALHIT will identify opportunities for increased use of information technology in the health and life sciences sector. The initiative will also identify research in academia and in the marketplace that can be commercialized or “spun out” with venture capital and other funding sources.

ALHIT has three or four mini conferences throughout the year that bring together users and developers of Health IT products. These meetings help to keep everyone up to date on the advancements that are being made in this space, to demonstrate new products that are currently serving a need in the industry as well as giving a chance for others to speak up regarding new needs that are arising and being recognized by health care officials. 

The mini conference held on March 6, 2013 included iSalus Healthcare Co-Founders and Board Members Michael Hall and Dr. Chuck Dietzen as well as Indigo BioSystems Founder and President Rand Julian and CEO Raul Zavaleta. Other speakers have included:

          On October 3, 2010, Ice Miller attorneys Mike Wukmer and Eileen Moore presented “Social Media Best Practices: Promoting and Protecting Your Institution” at the 2010 Central Association of College and University Business Officers (CACUBO) annual meeting.  A panel of representatives from various educational institutions joined Ice Miller in a discussion on how colleges and universities are using social media, related risk management issues and best practices related to social media.  Panelists included:

          The panelists shared their experiences and advice on using social media to promote their schools. According to Donohoe, the University of Michigan has found ways to use social media as an effective tool for prospective students.  Fanter discussed Ivy Tech’s recent “Why Ivy Tech” scholarship contest, which encouraged students to post YouTube videos on why they should receive a scholarship.  The student whose video received the most views received a $5,000.00 scholarship – roughly the equivalent of a semester at Ivy Tech. 

          One common theme throughout the panelists’ experience was the need to monitor social media used by and on behalf of the university or college, and the effect on the school’s budget.  As Wilson explained, social media has raised questions of the most effective way to allocate both time and staff resources in addition to strictly financial resources. Some schools, like Ball State University and Ivy Tech College, have used student interns to create and monitor content as well as increase the school’s social media presence.  For example, using summer interns, Marian University was able to increase its number of Facebook fans three-fold in less than two years. 

          The panelists also focused on their schools’ guidelines of the uses of social media.  The University of Michigan has both guidelines for staff members using social media as well as a separate policy for student athletes blogging for mgoblue.com, a site dedicated to Michigan athletics.  Ball State University, which recently hosted a conversation with David Letterman and Twitter co-founder Biz Stone, also has social media guidelines  which set forth the school’s institutional policy on the use of social media by students and faculty.  Other schools, like Marian University, have an overarching student code of student rights and responsibilities that covers all kinds of activities and communications while not specifying or limiting to guidelines to social media.  While facing ongoing concerns regarding privacy and other legal issues, each panelist agreed that social media was an effective tool for correcting misinformation, responding to criticisms, or communicating in a time of crisis.

Lucas Oil Becomes Principal Shareholder of MavTV

          Lucas Oil Products, Inc., a dominant name in oil, oil additives, and other automotive products, announced last week that it has become a principal shareholder in MavTV, a growing high definition cable network aimed primarily at an audience of men aged 18-54.  The move is destined to solidify MavTV as a powerful and significant outlet for Lucas Oil sports programming at many levels.  “The ultimate goal is to make MavTV the place for race fans to go to watch the stuff they want to see the most,”  said  Forrest Lucas, founder of Lucas Oil Products. “We’re trying to make it as easy as possible for people to keep up with the various types of racing out there. Motorsports is a lot more than just NASCAR. The grassroots stuff has a huge following but they haven’t always had a home on the big networks. Now they’ll have a dedicated TV network that’s happy to have them and promote them properly around the world.”   More…

Angie’s List and its members can celebrate a victory at the hands of a contractor who sued Angie’s List several years ago.  The lawsuit was triggered by the contractor’s disagreement about certain postings by Angie’s List Members on the Angie’s List website, www.angieslist.com, concerning work performed by the contractor.  The decision issued by a District of Columbia Court came after years of contentious litigation in which the contractor, Stephen Sieber, and his business, SCS Contracting Group, complained that Angie’s List, some of Angie’s List’s members, and the Washington Post financially ruined SCS and Sieber.  The Washington Post had published articles about Sieber’s dispute with Angie’s List and its members.  Sieber claimed damages in excess of $60 million. The Court exonerated Angie’s List, its members and the Washington Post on all issues. A copy of the decision can be accessed here.    

            Angie’s List was one of the first Internet sites to afford protection to consumers via on-line Internet ratings from other consumers.  In holding that Angie’s List was immune from defamation suits based on the postings of third parties on its interactive Internet site, the Court validated Angie’s List Business Model, which is a cornerstone of consumer protection on the Internet.

            For nearly fifteen years, Angie’s List has helped millions of consumers make informed decisions as to whom they should hire for various services (from plumbers and painters to dentists and dermatologists).  Today, Angie’s List members can research, rate, and review service providers across 450 different categories in more than 120 cities around the United States.  Angie’s List encourages honest assessment of service providers, so with more than 40,000 reports being submitted each month, not all of the comments contain positive comments about service providers.  The fact is Angie’s List’s members rely on each other to provide unbiased and reliable reviews (good or bad).  It is this type of assessment by Angie’s List members that adds the real value to the site for other Angie’s List members. 

            Angie’s List has developed numerous mechanisms to promote honest, reliable and valuable feedback.  For example, Angie’s List prohibits service providers from submitting reports about themselves or their competitors.  It also allows service providers to register with the website so they are notified when a report about them is submitted, and it gives the service provider an opportunity to respond, as long as the service provider follows an established protocol.  The result has been a website that allows consumers to make more informed decisions about who they hire and allows service providers the opportunity to monitor customers’ comments. 

            It is not surprising that some service providers disagree with comments by their customers.   In Sieber’s case, he charged (among many other things) that Angie’s List should be held liable for postings by its members about his business and also for refusing to publish his responses.  In rejecting those claims, the Court stated that:

It is important to specify that Angie’s List is immune from defamation suits based on the postings of third parties on its interactive Internet site, according to the federal law known as the Communications Decency Act of 1996, 47 U.S.C. §230 (c) (1). This is why the plaintiffs have no basis for suing based upon anything posted on Angie’s List.

The federal law commonly known as the Communications Decency Act provides that a website operator is not considered the “speaker” of any information placed on its website by another person, assuming the Internet operator complies with the definitions and requirements of the Act. Here, the content was on Angie’s List, but was provided by Angie’s List members. 

            It is also important to Angie’s List that its members know that they are protected by the law for making truthful statements on the Angie’s List website. Angie’s List believes that its members should feel vindicated in this multi-year struggle that Angie’s List protected their opinions as expressed on the website.

            The Court also rejected Sieber’s claims that Angie’s List wrongfully denied him the “right” to publish a response.  The Court clarified that legally Sieber had no legal “right” to a response, even if he conformed with applicable Angie’s List’s policies concerning responses by contractors.  In this instance, Sieber failed to comply with Angie’s List policies and therefore his response was not posted.  Angie’s List did send a notice to its members about Sieber’s company and published an article in its Member’s Magazine that included some of Sieber’s comments, but the Court found that these comments were also not defamatory. 

            In today’s internet marketplace, an increasing number of companies are providing a website forum where customers or members can post information and share their thoughts or experiences.  This recent ruling validates that the Communications Decency Act provides immunity to website operators who operate within the requirements of the Act.
